Blight, and other diseases, are risks of watermelon cultivation, or cultivation of
any crop at any time, now or in the future, including but not limited to other
plants, and diseases.
Crop diseases can affect everyone, not just home growers, farmers, but also commercial growers.
You the buyer, understand that planting
any crop, giving away seed, seeds, seedlings, sprouted seed, or selling, has certain risks associated with those
actions. The possibility arises that other diseases are possible, and may be
unknown or known. You the buyer also agree that if these seeds are given away,
sold, gifted, transferred, or cloned, that you must inform every person of this
license and terms set forth in this disclaimer, and known conditions of problems associated with seed diseases or crop
diseases, and I agree to release JellyRoot of any and all liability.
Also that no liability or action including, legal action, any kind of loss, loss of profits,
damages of any kind, damage to land, loss of income, infected seeds, etc, may
result. I the buyer waive all rights, fully, and completely to bring
any suit against JellyRoot for any Diseases of any Plants including seed, crops,
flowers.
You also agree to waive all rights to recover any and all damages of any kind relating to any seed,
,seedlings purchased from JellyRoot, as discussed below, please notify us in
writing should any such event occur.
I - we the buyers, or receivers of seed, further agree that this disclaimer applies
for the 2009 growing season, and all future growing seasons in which anyone uses
JellyRoot seeds, including Watermelon seed, and any other seed, including flowers,
and vegetables.
I - we the buyers, or any receivers of JellyRoot seed, seeds, seedlings, plants, grafts, clones, hybrids
,flowers, root divisions, transplanted crops etc, or such other products, from JellyRoot expressly agree to release
JellyRoot, any and all associates, of ultimately any and every possible legal action.
Notice concerning Watermelon seed, this is to let you know about a
disease called Watermelon Fruit Blotch. This is a bacterial disease, that causes
severe damage to some crops and land. To date, the organism and methods of infection have
not been positively identified. Methods of control have not been found to contain
this disease. JellyRoot makes no claims that any Watermelon seed we sell, has
any resistance, or toleration to Watermelon Fruit Blotch disease, or any other
diseases. JellyRoot does not assume
any liability caused by Watermelon seed. Plant at your own risk, please check
with you local agricultural department to acquire more information concerning any
diseases.
All buyers agree not to consume seeds of any packs, some seeds may be toxic to
humans, and animals if ingested. If ingestion of any poisonous substance occurs
please call Poison Control in your area or dial 911.
Prices, terms, conditions are subject to change without any notice.
Do not return any merchandise without express written approval from JellyRoot. No refund
or credit shall be given, or attained without pre-approval to return such
products, Seeds, ETC: A restocking fee may apply to all goods returned.
No credits, refunds or replacements shall be given after 90 days.
Invoice numbers and all packages must be returned in original condition, if approved, no exceptions.
JellyRoot and all associates, states that the seed we sell, conforms to the label description as required
by the State of West Virginia, and the Federal seed laws. JellyRoot makes no other
representations or warranties of any kind, express or implied, with respect to
the contents hereof, whether as to merchantability, and fitness, for a particular
purpose or any other matter. All claims (including alleged defective seeds) must be
made in writing. Within thirty (30) days after the facts are learned. The seeds
must have been purchased within that calendar years growing season. Any and all
claims not made in writing and received by JellyRoot within our time period specified
above shall be deemed waived, and agree to release JellyRoot and Associates of any
and all liabilities.
JellyRoot restricts the buyer, buyers from, duplicating, copying, reprinting, altering, scanning
changing, any graphic or logo by any means. All images and works are copyrighted,
©2009 JellyRoot. Express written consent must be obtained from JellyRoot - Alice
D. Christian, any and all infringements will be prosecuted to the fullest extent allowable by law.
Warning - Peppers
Please handle seeds and peppers responsibly, handle with extreme care. Use of gloves may be
necessary to protect hands, eyes, or mucus membranes. Use of an eye shield, gloves,
protective glasses should be used at all times, while working with hot peppers.
Please discard your gloves immediately after use, do not reuse them. Hot pepper seeds,
and peppers may cause severe or allergic reactions in some individuals, that could
result in injury or death. JellyRoot assumes no responsibility for any injuries
or death resulting from the handling, consumption, eating of hot peppers grown from
JellyRoot seeds, or from seeds purchased from JellyRoot.
It is realized that human error is a part of life, and mistakes
happen occasionally. These mistakes can be made in production, packing, processing,
or growing of seeds, and packaging of any seed, labeling etc. JellyRoot realizes that
seeds are living things, which can be affected by any number of factors,
including but not limited to: freezing temperatures, hot temperatures etc, these controls may not be maintained
with shippers, which leads us to say that JellyRoot cannot control every aspect
of the seeds condition due to factors which are basically beyond our control.
JellyRoot makes every effort possible to minimize any human error that
might occur. If a human error has occurred, we agree to correct any such conditions
as soon as possible. JellyRoot asks that you notify us in writing if such an
error has occurred, every attempt will be made to correct any such actions. However,
JellyRoot is limited to giving back only a refund of the purchase price of the
seeds, this does not include shipping/processing/handling/restocking fees.
JellyRoot customers please be aware that by ordering, you have expressly made
conditional your assent to these terms and all conditions provided herein. No
altered agreements will be accepted by JellyRoot. The buyer willfully, freely accepts
this agreement, and all writings herein expressed.
The liability of JellyRoot and all associates, for any and all losses and damages
to buyers resulting from any cause whatsoever including negligence,
breach of any warranty whether expressed or implied, or alleged defective seeds,
or breach of any contract whether expressed or implied, whether such defects
are found immediately or later, shall in no event exceed the purchase price of
the particular seed, to which losses or damages are claimed. In no event shall
JellyRoot and all associates be liable for any incidental or consequential damages,
including without limitation, loss of profits, loss of business, ETC. The buyer
assumes all responsibility of insurance, losses and lost packages due to shipping.
In no event shall JellyRoot be liable for lost packages, damaged packages, and
or the shipping/handling charges that are lost due to shipping damages. Please file these type of claims
with your shipper. Should any problem occurs during shipment please notify us immediately.
A notice about legal actions: You agree to settle all disputes with JellyRoot
in Clarksburg, Harrison County, State of West Virginia. You also agree
that all disputes may be arbitrated by a Third party first. All buyers agree that any
and all legal actions must be filed in Clarksburg WV. In no event shall JellyRoot
or any associate be required to appear or attend any court outside of Harrison
County, Clarksburg, West Virginia.
If you do not accept these terms and conditions herein, do not place an order.
By placing an order you(Buyer) are agreeing/accepting these terms and limitations,
to any and all conditions set herein in the disclaimer. All buyers agree to
comply to any such terms and conditions set forth in JellyRoots' disclaimer.
In the event that your state gives you the buyer any warranties or rights
under such conditions, by purchasing from JellyRoot you agree to waive your
personal states warranties, and accept this allowable disclaimer. You also agree
that if you do not agree to this disclaimer you have the right not to purchase
any such products from JellyRoot.
JellyRoot shall not be held responsible for any loss or damages. Should any order, or
contract be delayed by an act of GOD, Blockade, Government Action, Revolution,
War, Floods, Riots, Strikes, Lockouts, Detention at Sea, Fires, Volcanoes,
Earthquakes, Radiation, Nuclear Fallout, Plagues, epidemics, or any other such
event, that is beyond our control. All items subject to availability.
In no event has JellyRoot or any of its associates given the buyer any additional
rights, nor taken any away. Please abide by your local and federal laws when ordering
from JellyRoot. Please check with your local or federal laws on Exporting or Importing
seeds or products to your state or from any state to your country. Buyer agrees
not to purchase products from JellyRoot, should said products violate the laws within their state.
